Terms of service for Dust To Green

Dust To Green is delighted to offer its cleaning services to you under the terms outlined below. These Terms of Service constitute a legal agreement between you ("you" or "the customer") and Dust To Green ("we," "us," "our"). By using our services, you agree to comply with and be bound by these Terms, which may be updated from time to time. The term “Services” refers to our residential and commercial cleaning offerings, including the associated website and mobile application (collectively referred to as "the Platform").

By accessing or using the Platform, you:

  • Acknowledge that Dust To Green provides a platform for connecting customers with eco-friendly cleaning services.

  • Agree that you have read, understood, and accept these Terms of Service as they are updated periodically.

  • Consent to the collection and processing of your personal information, as detailed in our Privacy Policy, which is incorporated by reference into these Terms.

2. Use of the Service
Your access to and use of our services is conditioned upon your acceptance of and compliance with these Terms. By browsing or using the Platform, you confirm that you agree to adhere to these Terms.

3. The Dust To Green Platform
Dust To Green connects customers with professional cleaners offering eco-friendly cleaning services. You are free to select and communicate directly with cleaners, choose from various cleaning packages, and request services based on your needs.

We aim to verify the credentials of our cleaners, but cannot guarantee the qualifications or competence of any particular cleaner. While we encourage background checks, it remains the responsibility of the cleaner to ensure they meet all qualifications for the services they provide. Dust To Green is not liable for any inaccurate or incomplete information provided by cleaners or third parties.

When using the services, please exercise common sense and caution, especially when interacting with cleaners you may not have worked with previously.

4. Service Fees
The fees for cleaning services are as detailed on our website or app at the time of booking. By booking a cleaning service through Dust To Green, you agree to pay the associated fees. Please note that fees are generally non-refundable unless you cancel at least 24 hours before the scheduled appointment.

You are responsible for any applicable taxes (excluding taxes based on Dust To Green’s income) related to the cleaning services provided. Payment for services can be made using any valid method on our platform, such as a credit or debit card. Dust To Green reserves the right to pre-authorise your card to ensure sufficient funds are available to cover the service fees.

5. Payment Terms
The pricing for our cleaning services may change from time to time. Please be aware that the prices displayed on our website or app may not always reflect the current rates. We recommend checking for the latest pricing before confirming your booking. For certain cleaning packages, there may be additional charges depending on the service scope, such as special requests or extended cleaning times.

6. Payment Methods
All payments for cleaning services must be made through the payment options available on the Platform. If you make a booking through Dust To Green, your payment details will be securely processed, and we may store them for future transactions. If your payment fails or remains unpaid, you may be responsible for additional collection costs.

7. Account Credit
Dust To Green may offer account credit for future bookings. Any available credit will be applied to your next cleaning service automatically. Unused credits will expire 6 months after the last transaction on your account. Account credits cannot be transferred or redeemed for non-cleaning services.

6. Refund Policy
Fees paid for cleaning services prior to the service being performed are generally non-refundable. However, if you cancel at least 24 hours before the scheduled service, you will be entitled to a full refund. Cancellations made within 24 to 2 hours before the service will incur a charge equivalent to one hour of service time. If you cancel within 2 hours of the scheduled service, no refund will be issued. These cancellation fees apply regardless of whether the cancellation is initiated by you or by the Company, and they are applicable in cases of service disruption or termination of use, whether planned or unplanned, or for any other reason.

Any charges related to the Platform or other services will be invoiced and must be paid within the week following the submission of the invoice. Disputes related to cleaning service charges must be raised with the Company within 7 days of the charge being made. For any other service disputes, they must be addressed directly with the individual Worker involved.

7. Recurring Service
For recurring services, you may subscribe to cleaning services for an indefinite period. You can cancel this service at any time, with the standard refund policy applying to such cancellations.

8. Rescheduled Service
When a service is rescheduled, it is treated as a cancellation, and the standard refund policy will apply.

9. Messaging
When you register for our services, we may need to send you SMS or push notifications to verify your phone number or to keep you updated on the progress of the cleaning service being provided. Additionally, a Worker may contact you regarding a service they are performing or discussing with you. Some of these messages are essential for the service and cannot be opted out of. You acknowledge that, depending on your phone carrier, you may incur charges for these messages, and agree not to hold the Company liable for any costs associated with them.

10. Feedback
You are encouraged to provide us with feedback about the service, including any issues or malfunctions you experience (referred to as "Feedback"). By submitting Feedback, you grant us a non-exclusive, irrevocable, worldwide, royalty-free license to use, reproduce, disclose, modify, distribute, and otherwise use the Feedback to improve our services without restriction.

11. Privacy
Our Privacy Policy (available for review at [link]) is incorporated into these Terms by reference. It is important that you read this policy for details on how we collect, use, and share your personal information. By using the service, you agree to comply with our Privacy Policy and acknowledge your responsibility to stay informed of any updates to this policy.

12. Content and Reviews
Our Content and Review Policy (available for review at [link]) is also incorporated into these Terms. Please review this policy for guidelines on content and reviews created or submitted through the Platform. You agree to follow our Content and Review Policy and stay up-to-date on any changes.

13. Modification of Terms
We may notify you of changes to these Terms by posting them on our website or sending them to the email address you provided during registration. Notices are effective upon posting or email transmission. We may modify the Terms, Privacy Policy, and/or Content and Review Policy at any time. When we do, the updated version will be posted on the website, or we will send you a copy via email. We encourage you to review the Terms regularly. Changes to the Terms will become effective 30 days after posting or emailing, and by continuing to use the service after that, you agree to be bound by the modified terms.

14. Company Property
Your rights regarding the Service are strictly limited to those expressly granted in these Terms. You acknowledge and agree that Dust To Green and its licensors hold all rights, title, and interest in the Service, including any intellectual property, even if you contribute materials that may be incorporated into the service in future versions.

15. General Prohibitions
You agree not to engage in, or attempt (or request that any third party engage in) any of the following during or in connection with your use of the Service:

  • Circumvent or attempt to circumvent any access or use restrictions, data encryption, or content protection associated with the Service.

  • Engage in spidering, screen scraping, database scraping, harvesting email addresses, wireless addresses, content from the Service (including Content), or other automatic means of collecting user data or other information.

  • Copy, modify, or distribute any computer code used to generate web pages on the Service (except as expressly permitted under a separate license agreement).

  • Access, tamper with, or use non-public areas of the Service, our computer systems, or the technical delivery systems of our providers.

  • Probe, scan, or test the vulnerability of any system or network or breach any security or authentication measures.

  • Use any engine, software, tool, agent, device, or mechanism other than those provided by the Company or generally available third-party web browsers to search or access the Service.

  • Send unsolicited email, bulk emails, junk mail, spam, or chain letters, or promotions or advertisements for products or services, including those linked to products or services you have a business relationship with.

  • Use the Service to send altered, deceptive, or false source-identifying information.

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software used to provide the Service.

  • Interfere with or attempt to interfere with the access of any user, host, or network, including through the use of viruses, overloading, flooding, spamming, or mail-bombing the Site or Service.

  • Impersonate or misrepresent your affiliation with any person or entity.

  • Use the Service in violation of the Company’s or any third party’s intellectual property or other legal rights.

  • Use the Service in violation of any applicable law, or request that a Worker provide a service that would violate applicable law.

  • Upload, post, email, transmit, or otherwise make available materials that infringe or misappropriate any intellectual property or proprietary rights of others.

16. Termination of Use; Discontinuation and Modification of the Service
If you violate any of the Terms of Service, your permission to use the Service will automatically terminate. The Company may, at any time and without notice, suspend or revoke your access to the Service, including any accounts associated with it:

  • For any reason, or no reason at all.

  • To comply with legal requirements or to protect the rights or interests of the Company or any third party.

  • In connection with any general discontinuation of the Service.

We also reserve the right to modify the Service at any time without notice. We will not be liable for any changes to the Service or suspension/revocation of your access. You may terminate this agreement and your account by contacting customer service at info@dusttogreen.com .

17. Cancellation Policy
To cancel a Home Cleaning Job, the Company requires a minimum of 24 hours' notice. Cancellations made less than 24 hours before the scheduled time will incur a cancellation fee (refer to section 5 of the Terms). Cancellations should be made via email to info@dusttogreen.com . For other services, cancellations should be made directly with the Worker. Please understand any terms the Worker may have before booking non-cleaning services.

18. Indemnity
You agree to be personally responsible for your use of the Service, and to defend, indemnify, and hold harmless the Company and its affiliates from any claims, damages, or expenses arising from:

  • Your access to or use of the Service.

  • Your violation of the Terms of Service.

  • Your violation of any third-party rights, including intellectual property or privacy rights.

  • Any claim or allegation regarding the Company referring you to a Worker.

  • Any disputes between you and a Worker or third party.

The Company reserves the right to defend any matter at its own expense, and you agree to cooperate with our defense. You may not settle any claim without our written consent.

19. Use of the Service Is Entirely at Your Risk
You understand that your use of the Service is at your own risk, and the Service is provided "as is" and "as available." The Company disclaims all warranties, including those of fitness for purpose or non-infringement, to the maximum extent allowed by law. While feedback is tracked and Worker registrations are verified, the Company makes no warranties regarding the quality, reliability, safety, or accuracy of any service provided by a Worker.

20. Limitation of Liability and Release
To the extent allowed by law, the Company’s liability to you is limited to the total fees paid for the Service in the past six months. The Company is not liable for any indirect or consequential losses, such as loss of profits, business, or goodwill. However, this does not affect your statutory rights as a consumer or our liability for death or personal injury resulting from our negligence.

21. Governing Law; Venue
These Terms are governed by the laws of New Zealand. Any legal dispute will be handled in the courts located within New Zealand.

22. General
These Terms of Service, along with the Privacy Policy and Content and Review Policy, constitute the entire agreement between you and the Company regarding your use of the Service. You may not transfer or assign your rights without our written consent. We may assign these Terms at any time without notice. Failure to enforce any provision does not waive our right to enforce it later. If any part of these Terms is invalid or unenforceable, the remaining parts will remain in effect.

23. Liability
The Company’s liability for Home Cleaning Jobs is limited to the total price paid by you for those services. We are not liable for any other types of jobs or for any violations of these Terms by visitors, users, or Workers.

24. Events Beyond Our Control
We are not liable for any failure or delay in performing Jobs due to events beyond our control, such as strikes, system failures, natural disasters, or acts of terrorism.

25. Miscellaneous

  1. Invalidity: If any term of these Terms is deemed invalid or unenforceable, it will be severed, and the rest will remain in effect.

  2. Privacy: When booking a Job, we collect certain personal and transactional information. Please review our Privacy Policy for details.

  3. Entire Agreement: These Terms, along with our Privacy Policy, constitute the full agreement between us regarding your use of the Service.

  4. Third Parties: Except for affiliates or representatives, no third party has rights to enforce any terms under the Contracts (Rights of Third Parties) Act 1999.

  5. Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the New Zealand courts.
